A misdemeanor is any crime that is punishable by a year or less in jail. Some traffic offenses, such as Driving on a Suspended License, Drunk Driving and Improper Plates are misdemeanors rather than Civil Infractions. Unlike a felony, if a case goes to trial, the final jury will be six people rather than twelve. All the same constitutional rights, such as the right to have an attorney (unless there will be no term of imprisonment imposed), remain silent, a jury trial, subpoena witnesses, and cross examine witnesses remain in effect.
